Momentum Inc. (“Momentum,” “We,” or “Our”) is devoted to safeguarding the confidential and private information of Our clients. This Privacy Policy describes the information We collect, how We use it, and the standards and procedures in place to safeguard your personal private information.

Momentum strictly adheres to this Privacy Policy and the procedures described herein to ensure the confidentiality of Our clients’ personal private information. Momentum complies with all federal and state laws and regulations relating to the privacy of Our clients’ private information including health information (the “Personal Information”). Personal Information does not include any information publicly available about Momentum’s clients, potential clients, past clients, and users of the website (collectively, the “Clients,” “You,” or “Your”).

Information Momentum Collects 

We do not collect any Personal Information about Clients on Our website, unless the Personal Information is provided to Momentum voluntarily or derived from website navigation and usage of the Momentum website and online platforms.  Momentum collects, retains, and uses information from Clients including but not limited to the following: 

  • information that is required when You sign up for Momentum’s website;

  • contact information including but not limited to name, address, telephone number, email address, and emergency contact information;

  • information You share with Momentum during clinical visits and other communications with Momentum; 

  • “Public Information" which means the information You choose to make public and information that is publicly available;

  • credit card information for billing purposes; and

  • information gathered about a user of Momentum’s website through cookies and similar technologies including but not limited to information regarding usage of Our website, domain name, the number of hits, pages visited, previous/subsequent websites visited and length of user session.  

 

Uses of the Collected Data

Momentum uses non-personally identifying information to better design Our website and to use in research and trend analysis. For example, We may tell an advertiser that X number of individuals visited a certain area on Our website, or that Y number of men and Z number of women filled out a website survey or form, but We would not disclose anything that could be used to identify those individuals. We provide data to Our partners, if any, after We have removed Your name and any other personally identifying information from it or have combined it with other data in a way that it no longer personally identifies You. 

 

From time to time, We may use customer information for new, unanticipated uses not previously disclosed in this Privacy Policy. Momentum stores data only for as long as it is necessary (as determined by Momentum) to provide products and services to Clients and for legal protections or as required by applicable laws and regulations.

 

Momentum may disclose and/or use Clients’ Public Information that has been shared with Momentum through its website or through the services provided by Momentum.

 

We will provide Clients with access to a description of information that We maintain about them upon request. MomentumRI.org uses industry-standard encryption technologies when transferring and receiving consumer data exchanged with Our website. 

 

Momentum uses cookies and similar technologies to track usage of the website and to address security issues. We may also use cookies to store Your preferences relating to use of Our website. We do not share Personal Information about Clients except in the following circumstances:

  • during an emergency circumstance as determined by Momentum in its discretion;

  • You have authorized Momentum to disclose the Personal Information;

  • to computer services consultants and technicians or other security consultants, in order to ensure the confidentiality and security of Clients’ records;

  • to financial service providers or consultants to carry out requested services, and/or to protect against or prevent actual or potential fraud, unauthorized transactions, claims, or other liability;

  • to independent auditors or consultants in order to carry out institutional risk control;

  • to government or regulatory agencies, including self-regulatory organizations and to comply with a legal summons, court order, subpoena or a similar legal process, audit or investigation;

  • to swap data repositories; and

  • to third parties responsible for processing Your information (for example, credit card payment providers). 

 

How We Protect Personal Information

Momentum does not sell any Personal Information and takes the following measures to protect Clients’ Personal Information:

  • restricting access to Personal Information to only those personnel for whom the Personal Information is deemed necessary by Momentum in its discretion;

  • prohibiting third-parties from using the Personal Information for their own business purposes other than the purpose for which Momentum has engaged the third-party;

  • maintaining physical, electronic, and procedural safeguards that comply with relevant laws and regulations; and

  • using firewall barriers and digital certifications to maintain the security of Clients’ online sessions and Personal Information.

 

Disputes

You agree that You will resolve any claim, cause of action or dispute You have with Momentum arising out of or relating to this Privacy Policy or MomentumRI.org exclusively in a state or federal court located in Rhode Island. The laws of the State of Rhode Island will govern this Privacy Policy as well as any claim that might arise between You and Momentum, without regard to conflict of law provisions.  If anyone brings a claim against Momentum related to Your actions, content or information on MomentumRI.org, You will indemnify and hold Momentum harmless from and against all damages, losses, and expenses of any kind (including reasonable legal fees and costs) related to such claim.

 

Final Words from Momentum

MomentumRI.org and all of its content, specifically including any videos, podcasts, broadcasts, streaming of content, guidance, instruction, examples, questions and answers, promotional information, and other information (the “Information”) is provided solely and exclusively for informational and educational purposes.  Users and viewers may not rely on the Information or on any opinion expressed with respect to the same for any other purpose.  Momentum reserves the right to revise Information, and or to modify any features, specifications, or materials, without notice.

From time to time, the Information may include content posted, provided, or contributed by a third party.  Momentum does not endorse or warrant, and is not responsible for the accuracy or reliability, of any such content.  Likewise, from time to time, Information may include links to other websites maintained and controlled by third parties.  Momentum does not endorse or warrant, and is not responsible for the accuracy or reliability, of any such link or website.  

 

Momentum is not responsible for data lost, exposed, and/or used due to the nature of the Internet and digital environments, including but not limited to illegal actions of hackers and technical malfunctions of servers and/or databases. These are the accepted risks of Clients and users of the Internet in general. You are agreeing to this standard in using Momentum’s website.

 

Momentum reserves the right to amend this Privacy Policy at any time without notice and only the current Privacy Policy may be deemed effective. Regardless of later updates or changes to this Privacy Policy, We will never use the information You submit under Our current privacy notice in a new way without first providing You an opportunity to opt-out or otherwise prevent that use.
